In November 2021, in accordance with the "Decision of the State Council on Amending the Regulations for the Implementation of the Tobacco Monopoly Law of the People's Republic of China", after new tobacco products such as e-cigarettes were legally incorporated into the tobacco monopoly supervision system, the State Tobacco Monopoly Administration resolutely implemented the decisions and deployments of the Party Central Committee and the State Council, and systematically planned and coordinated the promotion of strengthening e-cigarette supervision. With the strong support of the Ministry of Industry and Information Technology, the Ministry of Public Security, the Ministry of Justice, the Ministry of Commerce, the General Administration of Customs, the State Administration for Market Regulation, the China Securities Regulatory Commission, the Post Office and other departments and local party committees and governments, a complete set of regulatory systems have been efficiently established, and a series of regulatory and law enforcement actions have been carried out in accordance with laws and regulations. The chaos in the e-cigarette industry has been fundamentally reversed, national tobacco control requirements have been fully implemented, people's health and safety, especially the physical and mental health of minors, have been effectively protected, an atmosphere of honest and law-abiding business operations has been fully formed, an orderly competition pattern has been basically established, the industry concentration has continued to increase, and the industry's outward-looking characteristics have become more distinct.
At present, e-cigarette regulation has entered deep waters, and the situation and tasks it faces are more complex and severe. From a domestic perspective, the phenomenon of e-cigarette product exports returning has increased, and illegal e-cigarettes continue to exist despite repeated bans. From an international perspective, global regulatory policies are becoming stricter and tighter, e-cigarette companies are frequently subject to trade investigations, and export trade risks continue to increase. Faced with new situations and new tasks, the State Tobacco Monopoly Administration insists on improving the regulatory system and strictly supervising in accordance with the law, continuously promoting the legalization of supervision, standardization of the industry, and professionalization of the team, and creating a new situation with new responsibilities and new actions.
First, adapt to new regulatory situations and continuously improve the regulatory system. In terms of the regulatory system, in order to adapt to the actual situation of e-cigarette companies and changes in regulatory needs, new rules on e-cigarette fixed asset investment management, technical review, transaction management, logistics management, etc. have been revised and issued. Recently, after soliciting public opinions, the "Management Rules for Tobacco Monopoly Licenses for E-Cigarette-Related Production Enterprises and Wholesale Enterprises" were revised to continuously improve the regulatory rules. In terms of the regulatory organizational system, the State Tobacco Monopoly Administration established the Electronic Cigarette Supervision and Management Department in accordance with the approval of relevant departments. Provincial tobacco monopoly bureaus adjusted and improved the electronic cigarette regulatory agencies, and regulatory forces were strengthened. In terms of joint supervision mechanism, tobacco monopoly bureaus at all levels have received broad support from local governments, and the public security, market supervision, customs, postal and other departments have worked together to manage them. Provincial tobacco monopoly bureaus in key areas such as Guangdong and Shenzhen have also established cross-regional joint cooperation mechanisms to widely gather regulatory efforts.
The second is to implement restrictive industrial policies and strictly manage market access. We strictly control production capacity, conscientiously implement the management requirements of the "Guidelines for Industrial Structure Adjustment (2024 Edition)" regarding "including new tobacco products such as e-cigarettes in the restricted category", and strengthen industrial policy guidance. Over the past year, we have prevented the construction of 103 new e-cigarette projects in violation of regulations, effectively preventing the disorderly expansion of e-cigarette production capacity and low-level duplicate construction. Prohibit new projects, continuously improve the overall management of supply and demand balance, strengthen the management of enterprise capacity verification, prohibit the addition of new capacity, and increase efforts to eliminate invalid and backward capacity. We strictly control the access to licenses, strengthen the management of the list of administrative licensing items, conduct strict reviews in accordance with the law, strengthen on-site and after-the-fact supervision, and promote the elimination of entities that have committed major crimes and have abnormal operations. Over the past year, we have revoked the licenses of 6 companies, approved the suspension of operations of 18 companies, and canceled or suspended 80 license items for 33 companies that were not operating. We will strictly control capital operations, deepen coordination and cooperation with securities regulatory authorities, strictly review the listing and stock issuance of e-cigarette-related companies, and curb the impulse for financing expansion.
The third is to crack down on the illegal production and sale of flavored e-cigarettes and resolutely regulate the market order. Since 2024, in order to further regulate the order of the e-cigarette market, the State Tobacco Monopoly Administration has uniformly deployed special law enforcement inspections, dispatched 190,000 law enforcement inspectors, carried out 6,948 joint law enforcement operations, supervised standardized operations 43,000 times, publicized and implemented regulatory policies 48,000 times, and completed full coverage inspections of 21,000 e-cigarette business entities. We strengthened supervision and law enforcement on licensed e-cigarette manufacturers, imposed a total of 13 administrative penalties on companies, and for the first time punished four domestic manufacturers that produced and sold products that were inconsistent with the information passed by technical reviews. Implement the opinions on strictly regulating administrative inspections involving enterprises, implement "double random, one public" supervision, complete the random inspections during the "Yuanchun" and "Yuanchun" festivals in 2025, and ensure a good and stable market order. Together with the National Narcotics Control Commission and the Ministry of Public Security, we jointly issued the "Opinions on Further Strengthening the Crackdown on and Rectification of Illegal and Criminal Activities Related to Electronic Cigarettes" to further deepen the crackdown on and rectification of electronic cigarette-related drug-related and prohibited substances. We will carry out in-depth special campaigns to protect minors from harm caused by e-cigarettes, and focus on rectifying the online sales of variant e-cigarette products such as "atomization" and "bar elves", and severely crack down on illegal activities involving e-cigarettes. Over the past year, tobacco monopoly bureaus at all levels have maintained a high-pressure situation in e-cigarette supervision and law enforcement, keeping a close eye on key links such as production, warehousing, transportation, retail, import and export, and cracking down on illegal production and sales of flavored e-cigarettes, resolutely curbing the rebound and spread of flavored e-cigarettes and the problem of export reflux. A total of 7,615 e-cigarette administrative cases and 2,470 criminal cases were investigated and dealt with nationwide, 23.28 million illegal e-cigarette products were seized, 2,263 people were held criminally responsible, and a strong deterrent was formed against criminal elements.
Fourth, we will work together online and offline to seriously investigate and deal with a number of major cases. The State Tobacco Monopoly Administration has built the second phase of the entire network's tobacco-related information monitoring platform and put it into operation in 2024, achieving seamless connection with the national online transaction supervision platform, using big data analysis technology to deeply explore case clues, and continuously managing illegal tobacco-related information and sales behaviors on e-commerce, social, short video, and live broadcast platforms. The efficiency of handling Internet tobacco-related product information has been significantly improved. Over the past year, the Shenzhen Center has collected a total of 791,000 pieces of tobacco-related information on the Internet. Through investigation and analysis of clues to the problem, tobacco, public security and other law enforcement departments have discovered and investigated a number of major criminal cases. For example, in the "November 16" major case of producing and selling counterfeit e-cigarettes in Suzhou, Anhui, a total of 50 criminal suspects were arrested in various places, 3 concentrated e-cigarette production points were destroyed, 111,900 e-cigarette products of various types were seized, the amount involved exceeded 400 million yuan, 24 people were held criminally responsible, and the illegal e-cigarette trading platform with the largest amount of money involved to date was successfully destroyed.
Fifth, take multiple measures to prevent export trade risks. Strengthen guidance of export industries. Support e-cigarette related manufacturers to improve their awareness of independent intellectual property rights and independent brands, and increase investment in related research and development and market development. Guide enterprises to fully consider investment risks and conduct overseas investment in accordance with the law. Standardize corporate exports, prevent disorderly competition, and enhance export competitiveness centered on high-quality enterprises and products. Strengthen the main responsibility of enterprises. Urge enterprises to strictly fulfill their obligations as the "first responsible person" to control quality and safety and prevent export trade risks, supervise enterprises to benchmark the laws, regulations and standards of the export destination countries (regions), strengthen the construction of export product quality and safety systems, and organize production and carry out exports in accordance with laws and regulations. Crack down on illegal and irregular exports. Focusing on key links such as product quality and safety, and customs declaration and export in accordance with the law, we will comprehensively use daily inspections, special inspections, product sampling and other means to strengthen the full process supervision of domestic production, logistics and transportation, export customs declaration, etc. of exported e-cigarettes, strictly investigate and punish illegal exports, severely crack down on false customs declarations, and resolutely curb export reflux. Grasp global regulatory trends. We have a deep understanding of the characteristics of the e-cigarette industry, pay close attention to the global e-cigarette trade situation and regulatory trends, build a global regulatory policy database, and issue risk warnings through multiple channels. Strengthen joint regulatory cooperation. Earlier, some media reported that licensed e-cigarette retailers in some areas illegally sold flavored e-cigarettes. The State Tobacco Monopoly Administration attached great importance to this and required the tobacco monopoly bureaus in relevant regions to conduct in-depth rectification of problems and risk investigations, and issued the "Notice on Severely Investigating and Punishing Illegal Acts Such as Selling Flavored E-Cigarettes by Licensed E-Cigarette Retailers" on May 9, which systematically deployed ten key tasks including strengthening daily supervision, cleaning up illegal information, and strengthening traceability crackdowns.
For a long time, the Party Committee of the State Tobacco Monopoly Administration has attached great importance to strengthening the supervision of licensed e-cigarette retailers in accordance with the law. According to relevant statistics, from 2024 to the present, tobacco monopoly bureaus at all levels have dispatched a total of 417,000 law enforcement personnel, inspected 191,000 licensed e-cigarette retailers, imposed administrative penalties on 1,941 households, imposed fines of 4.777 million yuan, suspended operations for 96 households, revoked the business qualifications of 97 households, and jointly with the public security and other departments investigated and handled 232 criminal cases involving licensed e-cigarette retailers, arrested 667 criminal suspects, sentenced 99 people, and effectively maintained the good order of the e-cigarette market.
In the next step, tobacco monopoly bureaus at all levels will make full use of 12313 hotline complaints, public reports, regulatory visits and other methods to focus on cracking down on illegal activities such as the sale of flavored e-cigarettes by licensed e-cigarette retailers, the sale of e-cigarettes to minors, the sale of e-cigarettes online, the sale of herbal atomizer e-cigarettes, the sale of oral cigarettes and other new tobacco products. They will further strengthen daily supervision of licensed e-cigarette retailers, improve and perfect the benchmark for administrative penalties and administrative discretion, strengthen the tracing and crackdown on illegal sales of flavored e-cigarettes, give play to the warning and deterrent effect of major typical cases, send a zero-tolerance high-pressure crackdown signal, and guide licensed e-cigarette retailers to conduct business activities in accordance with laws and regulations to safeguard the physical and mental health of the general public, especially minors.
It is the common responsibility of the whole society to purify the environment around the campus and protect minors from the harm of e-cigarettes. Please introduce what work the relevant departments have done in carrying out rectification around campuses and resolutely preventing e-cigarettes from invading primary and secondary school campuses?
Thank you for your question. For a long time, the State Tobacco Monopoly Administration has attached great importance to the protection of minors and has actively taken various effective measures to protect the physical and mental health of minors.
The first is to establish institutional norms and cut off online sales channels. In 2018 and 2019, the State Administration for Market Regulation successively issued the "Notice on Prohibition of Sale of Electronic Cigarettes to Minors" and the "Notice on Further Protecting Minors from Electronic Cigarette Harm", urging e-cigarette production and sales companies and individuals to close e-cigarette Internet sales websites or clients; urging e-cigarette platforms to promptly close e-cigarette stores and remove e-cigarette products from the shelves; urging e-cigarette production and sales companies and individuals to withdraw e-cigarette advertisements published on the Internet. We have pushed major online search platforms to stop providing e-cigarette advertising services; major e-commerce platforms have banned e-cigarette related keyword searches and blocked e-cigarette advertising information; and we have effectively rectified key areas and weak links in the sale of e-cigarettes to minors.
The second is to launch special operations to rectify the chaos of illegal offline sales. In 2022, we jointly launched a special campaign with the Ministry of Public Security, the State Administration for Market Regulation, and the Ministry of Education to clean up and rectify the sale of e-cigarettes to minors and crack down on e-cigarette-related crimes; from the end of 2022 to the beginning of 2023, we carried out special governance work on illegal e-cigarettes such as "milk tea cups" and "coke cans"; from May to June 2024, we organized a special campaign to protect minors from e-cigarette harm, and jointly with the State Administration for Market Regulation, we provided administrative guidance to leading platform companies to carry out rectification of cigarette card issues. Special operations have been carried out for five consecutive years, with a total of 1.773 million law enforcement personnel dispatched across the country, more than 25,000 tobacco sales outlets around primary and secondary schools and kindergartens cleared, nearly 1,000 automatic tobacco vending machines, 9,310 business entities dissuaded from selling cigarette cards, more than 1,200 cases of sales of e-cigarettes to minors investigated and dealt with, and a total of more than 3 million yuan in fines imposed.
The third is to carry out legal publicity and education to build broad social consensus. We planned and filmed three public welfare short videos on protecting minors from tobacco harm, which were played online more than 10 million times and became the content of the "first lesson of the new school term" in many places. We used methods such as posting slogans, making display boards, signing proposals, pushing videos and information online, and campus lectures to strengthen legal publicity at tobacco sales outlets and popular science publicity in the society, and enhance minors' awareness of consciously identifying and resisting e-cigarettes. We implemented the posting of minors protection warning signs by e-cigarette merchants, and implemented explicit commitments and age verification measures, and educated and guided tobacco sales practitioners to abide by laws and regulations and actively participate in the protection of minors. We promoted the formation of a joint regulatory force among tobacco, public security, market supervision, education, health and other relevant departments to jointly create a fresh environment conducive to the healthy growth of minors.
At present, the problem of e-cigarettes harming minors has not been eradicated, and illegal sales online and offline occur from time to time. We will continue to strengthen supervision and law enforcement, and we also hope to get the support and cooperation of schools, families and other relevant parties. The State Administration for Market Regulation attaches great importance to Internet-related tobacco supervision, and actively supports and cooperates with tobacco, public security and other departments in tobacco-related supervision and law enforcement to form a working synergy.
The first is to actively participate in improving the relevant policies and regulations on e-cigarettes, and cooperate in the special rectification of online sales of e-cigarettes. We actively participated in the formulation and revision of the "Tobacco Monopoly Law Implementation Regulations" and the "E-Cigarette Management Measures", and jointly issued two notices with the State Tobacco Monopoly Administration to prohibit the online sale of e-cigarettes to protect minors from the harm of e-cigarettes. In May 2024, we jointly provided administrative guidance to 10 major e-commerce platforms with the State Tobacco Monopoly Administration, requiring the platforms to establish and improve an independent cleanup mechanism for illegal tobacco-related information. According to the specific opinions of the State Tobacco Monopoly Administration, e-cigarette-related keywords will be included in the online banned goods dictionary and updated dynamically, and the platform will be urged and guided to strengthen regular management and control.
Secondly, we must insist on co-construction, co-governance and sharing, and provide strong support for the tobacco department to dynamically clean up and deal with information on online sales of e-cigarettes. In recent years, we have attached great importance to smart supervision and technological empowerment, established online communication channels between relevant regulatory authorities and platform companies, and supported the State Tobacco Monopoly Administration and other departments to directly issue relevant instructions and compliance reminders to the platforms to reduce the opportunities for the public, especially minors, to access e-cigarettes through the Internet.
Finally, strengthen the supervision of illegal e-cigarette advertising in accordance with the law. On the one hand, timely improve the regulatory rules for e-cigarette advertising. In 2023, we revised and issued the "Internet Advertising Management Measures", which clearly prohibits the use of the Internet to publish tobacco (including e-cigarette) advertisements. On the other hand, we will carry out e-cigarette advertising monitoring and urge and guide local market supervision departments to strictly investigate illegal e-cigarette advertising in accordance with the law.

In 2024, the State Tobacco Monopoly Administration specifically issued the "Reply on the Applicable Legal Issues of New Electronic Cigarette Products", which clearly stated that products that do not contain nicotine and are fully or partially vaporized into aerosols for people to inhale, suck, chew or nasal inhalation shall be managed in accordance with the regulations on electronic cigarettes. This type of herbal atomizer, which does not contain nicotine and is produced and sold under the guise of medical device registration or filing, and which fully or partially vaporizes into aerosol for people to inhale, suck, chew or snort, is an electronic cigarette. For this type of product, the following work is mainly carried out:
First, deepen departmental collaboration and strengthen source management. In September 2024, the State Tobacco Monopoly Administration and the State Food and Drug Administration conducted a joint investigation on the social hazards and regulatory status of herbal vaping e-cigarettes, identified the five core differences between herbal vaping e-cigarettes and medical devices in terms of usage methods, temperature, atomizer properties and other mechanisms, and jointly studied how to strengthen the supervision of herbal vaping e-cigarettes and avoid the stigmatization of medical devices. In 2025, the Medical Device Standard Management Center of the National Medical Products Administration revised the "Summary of Medical Device Classification and Definition Results in 2020-2021", invalidating the classification result of item 254, medical heated atomizer, thus eliminating the registration of herbal atomizing e-cigarettes as medical devices from the source.
The second is to maintain a high-pressure situation and resolutely clean up and rectify. We will organically combine key rectification with special regulation of online cigarette sales and regular supervision of e-cigarettes, and maintain a high-pressure crackdown on herbal atomizing e-cigarettes. From June to September 2024, the State Tobacco Monopoly Administration deployed a special campaign to combat the online sale of herbal vapor e-cigarettes. At the same time, we pushed 11 leading e-commerce platforms to completely remove herbal vapor e-cigarettes from their shelves; local tobacco monopoly bureaus took the initiative to coordinate and connect, interviewed Internet companies 65 times, and issued 36 regulatory letters. During the operation, 86 administrative cases and 37 criminal cases were investigated and dealt with, involving a total amount of 18.2211 million yuan, and more than 200,000 e-cigarette products involved in the cases were seized.
In the next step, our bureau will further deepen departmental collaboration, carry out policy publicity, maintain a high-pressure situation, and continue to crack down on illegal activities of selling e-cigarettes under the guise of medical devices.

After the special rectification work was launched, a number of typical cases have been uncovered recently: some licensed companies illegally manufactured e-cigarette products for unlicensed companies. Preliminary investigation revealed that an illegal enterprise in Guangdong organized some licensed enterprises to produce for it, illegally producing about 320,000 disposable electronic cigarettes, about 9,000 smoking devices, and more than 3,000 cigarette cartridges, with the on-site value of the goods being nearly 30 million yuan. At present, the illegal production enterprises have been filed for investigation by the local public security organs on suspicion of illegal business operations, and the licensed enterprises have been administratively filed by the local Tobacco Monopoly Bureau. Some licensed manufacturing companies illegally produce outside of their licensed locations without permission in the name of technological research and development. Two atomizer companies in Guangdong set up companies outside the licensed address without permission and illegally used nicotine to produce atomizers. Some companies produce e-cigarette products that do not meet the standards of the destination country (region). These companies are unable to produce certification documents that comply with the production standards of the destination country (region) and can be deemed to be non-compliant with the laws, regulations and standards of the destination country or region, and have violated relevant provisions of the e-cigarette management measures. Verified illegal acts will be dealt with strictly and promptly in accordance with the law.

Currently, the problem of e-cigarette smuggling is on the rise, disrupting market order, damaging corporate interests, and infringing on the physical and mental health of minors.
Since the beginning of this year, the Shenzhen Tobacco Monopoly Bureau has continued to increase its efforts to crack down on the smuggling and illegal sales of e-cigarettes in accordance with the deployment requirements of the Ministry of Public Security, the General Administration of Customs, and the State Tobacco Monopoly Administration.
