Morocco implemented mandatory standards for smoke-free products starting in February, regulating the market for e-cigarettes and nicotine pouches.<\/span><\/span><\/h2>\n<p><span dir=\"auto\">Starting in February 2026, Morocco will implement mandatory national standards for \"smoke-free products\" such as e-cigarettes, hookahs, and nicotine pouches for the first time. These standards, developed by the Moroccan National Institute for Standardization (IMANOR), aim to protect consumer rights and establish a regulated order in this previously unregulated and rapidly growing market.<\/span><\/p>\n<p><span dir=\"auto\">It is understood that this mandatory standard draws on internationally accepted guidelines, setting forth clear and specific requirements regarding\u00a0<\/span><span dir=\"auto\">product ingredients, labeling, traceability, and safety performance<\/span><span dir=\"auto\">\u00a0. Wadi Madhih, president of the National Federation of Consumer Associations of Morocco (FNAC), stated in a media interview that the standard is built upon\u00a0<\/span><span dir=\"auto\">two core pillars:\u00a0<\/span><strong><span dir=\"auto\">labeling<\/span><\/strong><span dir=\"auto\">\u00a0and\u00a0<\/span><strong><span dir=\"auto\">traceability .<\/span><\/strong><\/p>\n<p><span dir=\"auto\">According to Wadi Madhi, labeling is the first line of defense in protecting consumers. The eleven mandatory labeling requirements, including the manufacturer's name, product ingredients, country of origin, and production date, fully guarantee consumers' right to know. He also called on the government to increase public awareness campaigns to ensure the public is fully aware of the potential harms of tobacco products and their alternatives.<\/span><\/p>\n<p><span dir=\"auto\">It is worth noting that this is the first time Morocco has established a regulatory framework for smoke-free products. Since there are no domestic manufacturers of such products in Morocco, the standard will apply to all imported smoke-free products, which must meet the various indicators set by the Moroccan Institute of Standardization in order to be sold in the Moroccan market.<\/span><\/p>\n<p><span dir=\"auto\">From a legal perspective, the introduction of this new standard is an extension and improvement of Morocco's tobacco regulatory legal system. Previously, Morocco amended Tobacco Law No. 46-02 through Law No. 66-20, bringing heated tobacco products under its regulatory scope. Now, with the rise of new tobacco products such as e-cigarettes, Morocco is continuously adjusting its legal system to adapt to increasingly diverse forms of tobacco consumption\u2014these new products are often mistakenly perceived by some consumers as \"less harmful,\" but this perception is not necessarily accurate.<\/span><\/p>\n<p><span dir=\"auto\">Wadi al-Madhi concluded by emphasizing that Morocco's standardization of smokeless tobacco products is not intended to \"legitimize\" these products, but rather to establish a transparent and responsible market environment. \"The advancement of standardization will ultimately help consumers choose the least harmful option among a wide range of products.\"<\/span><\/p>\n<h1 data-pm-slice=\"0 0 []\"><span dir=\"auto\">II. New Regulations for E-cigarette Shops in Dalton, USA: Licensing System + Strict Restrictions on Operating Areas<\/span><\/h1>\n<section><span data-pm-slice=\"0 0 []\"><span dir=\"auto\">Dalton, Georgia,<\/span><span dir=\"auto\">\u00a0is considering a proposal to impose stricter regulations on e-cigarette shops.<\/span><\/span><\/section>\n<ul class=\"list-paddingleft-1\">\n<li><span dir=\"auto\">Licensing System:<\/span><span dir=\"auto\">\u00a0The new regulations require all e-cigarette shops to obtain a special license issued by the municipal government.<\/span><\/li>\n<\/ul>\n<ul class=\"list-paddingleft-1\">\n<li><span dir=\"auto\">Strict territorial restrictions<\/span><span dir=\"auto\">\u00a0apply: the agreement clearly defines prohibited areas for e-cigarette shops, requiring them to maintain a distance of at least 1,000 feet from public facilities such as schools, churches, libraries, parks, and fitness facilities. However, existing e-cigarette shops are not affected by these territorial restrictions and will only be subject to the new regulations when the shop is transferred or the license expires.<\/span><\/li>\n<\/ul>\n<p><span data-pm-slice=\"0 0 []\"><span dir=\"auto\">Bruce Frazier, a spokesperson for the City of Dalton, stated that\u00a0<\/span><span dir=\"auto\">one of the key reasons for Dalton's push for the ordinance was to \"establish necessary regulations for the health and well-being of its residents,\" and that the ordinance referenced practices in other cities in Georgia.<\/span><\/span><\/p>\n<h2><span dir=\"auto\">III. The Polish Ministry of Finance plans to levy a consumption tax on reusable e-cigarette cartridges.<\/span><\/h2>\n<p data-pm-slice=\"0 0 []\"><span dir=\"auto\">On February 3, 2026, it was reported that the Polish Ministry of Finance plans to amend the Excise Tax Act and the Fiscal Criminal Code Act, proposing to classify reusable e-cigarette cartridges as a new type of taxable product subject to excise tax, with a proposed excise tax rate of\u00a0<\/span><span dir=\"auto\">40 z\u0142oty per item<\/span><span dir=\"auto\">\u00a0.<\/span><\/p>\n<ul class=\"list-paddingleft-1\">\n<li><span dir=\"auto\">The Polish Ministry of Finance will redefine the scope of reusable e-cigarette cartridges to include all types of e-cigarette liquid containers and other e-liquid-related accessories that can be used as cartridges. At the same time, it will adjust the definition of disposable and reusable e-cigarettes, removing cartridges from the definition.<\/span><\/li>\n<li><span dir=\"auto\">The bill proposes that reusable e-cigarette bodies compatible with cartridges will no longer be subject to consumption tax, and that multifunctional e-cigarette devices, regardless of whether the cartridges are fixed, will be replaceable, with the consumption tax collection rules remaining unchanged.<\/span><\/li>\n<li><span dir=\"auto\">This amendment to the bill also includes adaptation modifications to the Fiscal Criminal Code related to the taxation of new taxable products. The Ministry of Finance also plans to set a six-month transition period for the revised regulations to facilitate companies in completing their consumption tax license applications and adjusting product labeling.<\/span><\/li>\n<li><span dir=\"auto\">The Polish government plans to review and pass the revised bill on consumption tax in the second quarter of 2026, and the bill has been included in the government's legislative work plan.<\/span><\/li>\n<\/ul>\n<h1 data-pm-slice=\"0 0 []\"><span class=\"js_title_inner\"><span dir=\"auto\">IV. The Irish government requires e-cigarette retailers to pay an annual license fee.<\/span><\/span><\/h1>\n<section data-pm-slice=\"0 0 []\"><span dir=\"auto\">From February 2, 2025, Ireland will implement a new licensing system requiring retailers to pay an annual fee to sell e-cigarettes and tobacco products. Retailers must pay \u20ac800 annually to sell e-cigarette products and \u20ac1,000 annually to sell tobacco products. Currently, smokeless nicotine pouches are not subject to this regulation.<\/span><\/section>\n<section><span dir=\"auto\">The health service authority will monitor compliance and conduct inspections to ensure adherence to the new regulations. Licenses are renewed annually, and retailers found to be in violation may lose their license to sell e-cigarette products. Previously, selling tobacco only required a one-time fee of \u20ac50, while e-cigarette products did not require a license.<\/span><\/section>\n<section><span dir=\"auto\">David Melinn, regional manager for British American Tobacco Ireland, supports the licensing system, stating that it will help enforce the ban on the sale of e-cigarettes to those under 18 and prevent illicit sales. However, he expressed concern about excluding smokeless nicotine pouches from the legislation and hopes future amendments will address this oversight.<\/span><\/section>\n<section><span dir=\"auto\">The introduction of these fees is part of the Public Health (Tobacco Products and Nicotine Inhalation Products) Act 2023, reflecting Ireland's commitment to regulating the sale of nicotine products and reducing minors' access to them.
