Alabama Governor Kay Ivey signed HB8 last week, limiting convenience stores to only 34 tobacco and mint flavors approved by the FDA. Alabama.com\u00a0<\/span><\/span>said that\u00a0<\/span><\/span>except for age-restricted e-cigarette stores, all other flavors of e-cigarette products (including thousands of flavors currently awaiting FDA review) will be banned from sale.<\/span><\/span><\/section>\n

              • Starting October 1, 2025, e-cigarette liquids, e-cigarettes (ENDS), or alternative nicotine products newly added to the catalog\u00a0<\/span>must be manufactured, packaged, and labeled in the United States unless they have obtained FDA marketing authorization.<\/span><\/span><\/strong>
                \n<\/span><\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ol>\n

                2. The retail industry suffered an \"earthquake-like\" impact<\/span><\/span><\/span><\/strong><\/h3>\n

                Under the bill, convenience stores across the state would be required to remove flavored e-cigarette products from their shelves. An industry representative recently said the proposal would hit small businesses hard, noting that alternative nicotine products account for about 30% of convenience store sales.<\/span><\/span><\/p>\n

                2. Specialty stores must hold a certificate before they can work<\/span><\/span><\/strong><\/p>\n

                E-cigarette stores must install\u00a0<\/span><\/span>a third-party age verification system<\/span><\/span><\/strong>\u00a0, scan ID cards before entering the store, and prohibit people under 21 from entering. Violators will be fined $1,000 for the first time, and\u00a0<\/span><\/span>repeat offenders will be fined more heavily and may have their licenses revoked<\/span><\/span><\/strong>\u00a0.<\/span><\/span><\/p>\n
